IN THE INTERMEDIATE COURT OF APPEALS

OF THE STATE OF HAWAI`I

STATE OF HAWAI`I, Plaintiff-Appellee, v.
DEMETRIUS WOODS, Defendant-Appellant

APPEAL FROM THE FAMILY COURT OF THE FIRST CIRCUIT
(FC-CRIMINAL NO. 03-1-2516)

SUMMARY DISPOSITION ORDER
(By: Burns, C.J., Lim and Nakamura, JJ.)

Demetrius Woods (Defendant) appeals the June 7, 2004 judgment of the Family Court of the First Circuit (family court) (1) that convicted him, upon a jury's verdict, of abuse of a family or household member.

After a meticulous review of the record and the briefs submitted by the parties, and giving careful consideration to the arguments advanced and the issues raised by the parties, we conclude there was substantial evidence adduced at trial to negative Defendant's parental discipline defense and to convict him of abuse. State v. Stocker, 90 Hawai`i 85, 90, 976 P.2d 399, 404 (1999).

Therefore,

IT IS HEREBY ORDERED that the family court's June 7, 2004 judgment is affirmed.

DATED: Honolulu, Hawai`i, June 28, 2006

On the briefs:

Traci Rei Garrido Morita,
Deputy Public Defender,
for Defendant-Appellant.

Stephen K. Tsushima,
Deputy Prosecuting Attorney,
City and County of Honolulu,
for Plaintiff-Appellee.
