IN THE INTERMEDIATE COURT OF APPEALS

OF THE STATE OF HAWAI`I

VERONICA D. NASH-GIVENS, Plaintiff-Appellant, v.
KAISER FOUNDATION HEALTH PLAN, INC., Defendant-Appellee

APPEAL FROM THE CIRCUIT COURT OF THE FIRST CIRCUIT
(CIVIL NO. 03-1-1909)

SUMMARY DISPOSITION ORDER
(By: Lim, Acting C.J., Foley and Fujise, JJ.)

Veronica D. Nash-Givens (Plaintiff) appeals the January 25, 2005 judgment of the Circuit Court of the First Circuit (circuit court). (1)

After a painstaking review of the record and the briefs submitted by the parties, and giving careful consideration to the arguments advanced and the issues raised by the parties, we hold that the circuit court properly granted summary judgment against Plaintiff, because her medical malpractice lawsuit was barred by the statute of limitations. Hawaii Revised Statutes (HRS) § 657-7.3 (1993); HRS § 671-18 (Supp. 2005); Hays v. City and County of Honolulu, 81 Hawai`i 391, 396, 917 P.2d 718, 723 (1996); Yamaguchi v. Queen's Medical Center, 65 Haw. 84, 90, 648 P.2d 689, 693-94 (1982).

Therefore,

IT IS HEREBY ORDERED that the January 25, 2005 judgment of the circuit court is affirmed.

DATED: Honolulu, Hawai`i, April 26, 2006
