NO. 27192

IN THE INTERMEDIATE COURT OF APPEALS

OF THE STATE OF HAWAI`I

STATE OF HAWAI`I, Plaintiff-Appellee, v.
IRIS GUSHIKEN, Defendant-Appellant

APPEAL FROM THE FAMILY COURT OF THE SECOND CIRCUIT
(FC-CRIMINAL NO. 04-1-0884)

SUMMARY DISPOSITION ORDER
(By: Burns, C.J., Lim and Fujise, JJ.)

Iris Gushiken (Defendant) appeals the February 10, 2005 judgment of the Family Court of the Second Circuit (family court) (1) that convicted her of abuse of a family or household member.

After a meticulous review of the record and the briefs submitted by the parties, and giving careful consideration to the arguments advanced and the issues raised by the parties, we disagree with Defendant's sole point of error on appeal, that the State adduced insufficient evidence at trial to disprove her justification defense of self-defense. On the contrary, there was substantial evidence to support the family court's findings. State v. Eastman, 81 Hawai`i 131, 135, 139, 913 P.2d 57, 61, 65 (1996).

Therefore,

IT IS HEREBY ORDERED that the family court's February 10, 2005 judgment is affirmed.

DATED: Honolulu, Hawai`i, August 15, 2006.

On the briefs:

Lee S. Hayakawa,
for Defendant-Appellant.

Artemio C. Baxa,
Deputy Prosecuting Attorney,
County of Maui,
for Plaintiff-Appellee.
