NO. 27230

IN THE INTERMEDIATE COURT OF APPEALS

OF THE STATE OF HAWAI`I

JARED PUUOHAU, Plaintiff-Appellant, v.
BARRY MEYER, Defendant-Appellee

APPEAL FROM THE CIRCUIT COURT OF THE FIRST CIRCUIT
(Civ. No. 04-1-2298)

SUMMARY DISPOSITION ORDER
(By: Burns, C.J., Lim and Foley, JJ.)

Jared Puuohau (Plaintiff) appeals the April 22, 2005 final judgment that the Circuit Court of the First Circuit (circuit court) (1)   entered in favor of Barry Meyer (Defendant). On the same day, three predicate orders were filed, (1) the order granting Defendant's March 1, 2005 motion to dismiss the complaint for failure to state a claim, (2) the order denying Plaintiff's March 10, 2005 motion for entry of default and default judgment, and (3) the order denying Plaintiff's March 14, 2005 motion for entry of default and default judgment.

After a painstaking review of the record and the briefs submitted by the parties, and giving careful consideration to the arguments advanced and the issues raised by the parties, we affirm the circuit court's April 22, 2005 final judgment.

DATED: Honolulu, Hawai`i, March 17, 2006.

On the briefs:

Jared Puuohau,
Plaintiff-Appellant,
pro se.

Roy Tjioe and
Emily Reber Porter
(Goodsill Anderson Quinn & Stifel),
for Defendant-Appellee.
