Upon consideration of the request for attorney's fees and expenses
submitted on March 5, 2007, by Steven Booth Songstad,
Esq., attorney for Defendant-Appellant Christopher B. Grindling,
pursuant to Hawai`i Rules of Appellate Procedure Rule 39
and Hawaii Revised Statutes § 802-5 (1993), as well as the
attachments thereto and the record, it appears that expenses in
the amount of $93.98 are reasonable and the amount of $2,009.00
requested for attorney's fees is unreasonable. Therefore,IT IS HEREBY
ORDERED that expenses in the amount of $93.98 and attorney's fees in
the lesser amount of $1,937.00
(46.40 at $40/hour and .9 at $90/hour) are approved.
