APPEAL FROM THE CIRCUIT COURT OF THE FIRST CIRCUIT
(CV. NO. 04-1-0390)

ORDER DENYING PLAINTIFF-APPELLANT LESLIE L.
HAMAOKA'S MARCH 28, 2007 MOTION FOR RECONSIDERATION
(By: Burns, C.J., Lim and Foley, JJ.)

Upon review of (1) Plaintiff-Appellant Leslie L. Hamaoka's (Appellant Hamaoka) March 28, 2007 motion, pursuant to Rule 40 of the Hawai`i Rules of Appellate Procedure (HRAP), for reconsideration of the March 23, 2007 order denying Appellant Hamaoka's motion to stay this appeal, and the March 23, 2007 order dismissing appellate court case number 28329 for lack of jurisdiction, and (2) the record, it appears that Appellant Hamaoka's March 28, 2007 HRAP Rule 40 motion for reconsideration lacks merit. Therefore,

IT IS HEREBY ORDERED that Appellant Hamaoka's March 28, 2007 HRAP Rule 40 motion for reconsideration of the two March 23, 2007 orders is denied.

DATED: Honolulu, Hawa`i, April 4, 2007.
