Upon review of the record, it appears that: (1) Defendant-Appellant Frank J. Santiago, proceeding pro se, filed a notice of appeal on June 7, 2007; (2) on August 6, 2007, the appellate clerk informed Appellant that the jurisdictional statement was due on August 16, 2007, and the opening brief was due on September 15, 2007; (3) Appellant filed the jurisdictional statement, but he did not file the opening brief; (4) on September 24, 2007, the appellate clerk informed Appellant: (a) the time to file the opening brief expired; (b) the matter would be brought to the attention of the court on October 1, 2007 for such action as the court deems proper; and (c) the appeal may be dismissed pursuant to HRAP Rule 30; (5) Appellant did not file the opening brief or otherwise respond to the notice of default.  Therefore,
IT IS HEREBY ORDERED that the appeal is dismissed pursuant to HRAP Rule 30.
