Upon review of the record, it appears that: (1) on June 27, 2007, Defendant-Appellant Calvert Williamson filed a notice of appeal; (2) on August 27, 2007, the appellate clerk filed the record on appeal and notified Appellant the statement of jurisdiction was due on September 4, 2007 and the opening brief was due on October 6, 2007; (3) Appellant failed to file the statement of jurisdiction and the opening brief; (4) on October 19, 2007, the appellate clerk informed Appellant: (a) the time to file the statement of jurisdiction and opening brief had expired, (b) the matter would be called to the attention of the court for such action as the court deems proper, and (c) the appeal may be dismissed pursuant to HRAP Rule 30; (5) Appellant did not seek relief from this default or file the statement of jurisdiction and opening brief. Therefore,

IT IS HEREBY ORDERED that the appeal is dismissed pursuant to HRAP Rule 30.
