NO. 28659

IN THE INTERMEDIATE COURT OF APPEALS

OF THE STATE OF HAWAI‘I

SARA CORDER, Plaintiff-Appellant, v.
JAMES GRIMSHAW, Defendant-Appellee

APPEAL FROM THE DISTRICT COURT OF THE FIRST CIRCUIT
(CIVIL NO. 1RC06-1-5271)

ORDER
(Recktenwald, C.J., Watanabe and Nakamura, JJ.)

Upon consideration of Plaintiff-Appellant Sara Corder's (1) Motion to Extend Time to File Notice of Appeal, received on October 2, 2007, and (2) request for reconsideration of this court's October 1, 2007 Order Dismissing Appeal, filed on October 2, 2007, it appears that:

(1) On October 1, 2007, this court dismissed Appellant's appeal for lack of jurisdiction as premature, because this court does not have jurisdiction over the appeal until the district court files its written final judgment in district court civil no. 1RC06-1-5271; and

(2) In light of the above, and pursuant to Rule(a)(1) of the Hawai‘i Rules of Appellate Procedure, Appellant may file her notice of appeal within 30 days after the district court files its written final judgment;

THEREFORE, IT IS HEREBY ORDERED that:

(1) The motion to extend time to file notice of appeal is denied;

(2) The request for reconsideration of this court's October 1, 2007 Order Dismissing Appeal is denied; and

(3) The appellate clerk is directed to serve a copy of this order upon the Honorable Gerald H. Kibe, Judge of the District Court of the First Circuit.

DATED: Honolulu, Hawai‘i, October 11, 2007.
