IT IS HEREBY ORDERED that the opinion of the court filed on January 9, 2008, is amended as follows:

On page 15, lines 7 and 8, the words "abused its discretion" are deleted and replaced with the word "erred."

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of this change.
