The Summary Disposition Order of the court, filed on September 30, 2008, is hereby amended as follows:

On page 14, in lines 4 through 6, the following amendment shall be made, with material to be deleted in brackets
and new material underscored and bolded:

This disparity was present [in the original version of the statute] when prior versions of the statute were amended and subsections (a) and (b) were reenacted together. See 1959 Haw. Sess. L. Act 241, §2, at 186; 1963 Haw. Sess. L. Act 116, § 1 at p. 122.

The clerk of the court is directed to incorporate the foregoing change in the original opinion and take all necessary steps to notify the publishing agencies of this change.
