IT IS HEREBY ORDERED that the Opinion of the court, filed on July 14, 2008, is hereby corrected at page 1, in the caption section, to change the word "Respondent-Appellant" to "Respondent-Appellee" so that the caption reads:

STATE OF HAWAI‘I, Respondent-Appellee

The clerk of the court is directed to incorporate the foregoing change in the original opinion and take all necessary steps to notify the publishing agencies of this change.
