ORDER OF CORRECTION
(By: Nakamura, J., for the court (1))

The Opinion of the court, filed on September 16, 2008, is hereby corrected as follows:

    1.     On page 4, in the last line of text, delete the comma after the word "review" so that as corrected, the text reads as follows: ". . . the requested peer review and 2) allow Pavich to refile . . . ."

    2.     On page 5, in the fourth line of text from the bottom of the page, an "s" should be added at the end of "Avilla'" so that as corrected, the text reads as follows: ". . . friend of Avilla's cousin, Mitchell Williams."

    3.     On page 7, in the third line of the third full paragraph, the brackets around the letter "w" should be deleted and that letter should be capitalized so that as corrected, the text reads as follows: "Avilla told Abraham, "We went kill somebody.""

    4.     On page 25, in the last line of the second full paragraph, the page reference following "1 P.3d" in the Balanza citation should be changed from "289" to "291" so that as corrected, the citation reads as follows: "Balanza, 93 Hawai‘i at 289, 1 P.3d at 291."

The clerk of the court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of these changes.
