Upon review of (1) the December 17, 2007 order dismissing the appeal by Plaintiff/Counterclaim-Defendant/Appellant Olga M. Lansing (Appellant Lansing) in appellate court case number 28716, (2) Appellant Lansing's January 3, 2008 request to reinstate her appellate case, which we deem to be a motion for reconsideration of the December 17, 2007 order of dismissal pursuant to Rule 40 of the Hawai‘i Rules of Appellate Procedure (HRAP), and (3) the record, it appears that Appellant Lansing's January 3, 2008 HRAP Rule 40 motion for reconsideration of the December 17, 2007 order of dismissal is untimely and lacks merit. Therefore,

IT IS HEREBY ORDERED that Appellant Lansing's

January 3, 2008 HRAP Rule 40 motion for reconsideration of the December 17, 2007 order of dismissal is denied.
