ORDER AMENDING SUMMARY DISPOSITION ORDER
(By: Nakamura, C.J., Watanabe, and Fujise, JJ.)

The Summary Disposition Order filed on September 24, 2009 is hereby amended as follows:

        On page 9, the sentence under section "D" that reads: "The final judgment entered by the circuit court on May 5, 2008 is affirmed." shall be omitted and replaced with the following sentence: "The final judgments in favor of KRS Development, Inc.; KRS Associates I, LLC; and KRS Associates, II, LLC entered by the Land Court of the State of Hawai‘i on December 12, 2006 in two cases involving real property in Kula, Maui are affirmed."

The Clerk of the Court is directed to incorporate the foregoing change in the original opinion and take all necessary steps to notify the publishing agencies of the change.
