The memorandum opinion filed by this court on January 7, 2009 is hereby amended as follows:

On page 46, the entire paragraph in the conclusion section shall be replaced with the following:

In light of the foregoing discussion, we vacate those parts of the judgment entered by the circuit court on March 14, 2007 relating to the assault 2 and household-abuse offenses and remand for further proceedings consistent with this opinion. In all other respects, we affirm.

The clerk of the court is directed to incorporate the foregoing change in the original opinion.
