Upon consideration of Plaintiff-Appellee Jeff John Silva's Motion to
Dismiss
Appeal of Defendant-Appellant Paul Lanakila Campos (Appellant), the
papers in
support, and the records and files herein, it appears that: (1)
Appellant filed
the notice of appeal on July 1, 2008; (2) Appellant filed the statement
of
jurisdiction, but he did not file the opening brief; (3) on January 30,
2009, the
clerk's office informed Appellant: (a) the time to file the opening
brief
expired; (b) the matter would be called to the attention of the court
on February
6, 2009; and (c) the appeal may be dismissed pursuant to HRAP Rule 30;
(4) Appellant did not respond to the notice of default or file the
opening brief; and (5) Appellant did not respond to the motion to
dismiss his
appeal or otherwise oppose dismissal.
Therefore, IT IS
HEREBY ORDERED that Plaintiff-Appellee Jeff John Silva's Motion
to Dismiss Appeal of Defendant-Appellant Paul Lanakila Campos is
granted, and the
appeal is dismissed.
