Upon consideration of Plaintiff-Appellee State of Hawai‘i's Ex Parte Motion to Strike Supplement to Opening Brief, the papers in support, and the records and files herein, it appears that: (1) on May 27, 2009, the court appointed counsel for Defendant-Appellant Chris Grindling (Appellant) filed the opening brief; and (2) the court did not grant Appellant leave to file a supplement to the opening brief.

Therefore, IT IS HEREBY ORDERED that the Ex Parte Motion to Strike Supplement to Opening Brief is granted, and the Supplement to Opening Brief is stricken.
