Upon consideration of Petitioner Office of Disciplinary Counsel's (Petitioner ODC) October 25, 2005 motion for partial reconsideration of the October 17, 2005 order denying reinstatement pursuant to Rule 40 of the Hawai`i Rules of Appellate Procedure, and the record, it appears that the record of this case and Petitioner ODC's memorandum in support of the motion do not show good cause for the lengthy delays in processing this case after the February 12, 2004 remand. Therefore,

IT IS HEREBY ORDERED that Petitioner ODC's motion for partial reconsideration of the October 17, 2005 order denying reinstatement is denied.
