The concurring opinion of Acoba, J., filed on November 29, 2005 in the above-entitled case, is corrected as follows:

At page 7, line 6 from the bottom, delete the words "concurring opinion" at the beginning of the sentence, and replace it with "id." so that the line reads:

id. at 4, is at best an untenable judicial

IT IS HEREBY ORDERED that the clerk of the court is directed to incorporate the foregoing change in the original concurring opinion of Acoba, J., and take all necessary steps to notify the publishing agencies of this change.
