NAKAYAMA AND ACOBA, JJ., DISSENTING

Based on the record before us and in the absence of any prior suspension, we dissent to the extent that we do not agree with disbarment. We would grant Respondent Richard Y. S. Lee's (Respondent Lee) October 10, 2005 motion for reconsideration to the extent that we would suspend Respondent Lee from the practice of law for five years.
