It appearing that footnote 1 of this court's opinion in the above-captioned matter, filed August 11, 2006, erroneously referred to Rule 43(c) the Hawai`i Rules of Civil Procedure as opposed to the Hawai`i Rules of Appellate Procedure,

IT IS HEREBY ORDERED that the reference in the footnote is amended as follows (deleted material is stricken; new material is underscored): "Hawai`i Rules of Civil Appellate Procedure (HRCAP)."

The Clerk of the Court is directed to incorporate the foregoing corrections in the original opinion and take all necessary steps to notify the publishing agencies of the correction.
