Upon review of the Opinion of the Court filed in this case on December 19, 2005, it appears that the Opinion reflects incorrect deputy attorneys general who wrote the brief on behalf of the State of Hawai`i. Therefore,

IT IS HEREBY ORDERED that the names of Dorothy Sellers and Kimberly Tsumoto, Deputy Attorneys General, shall be substituted in place of David A. Webber and Deborah Day Emerson, on behalf of defendant-appellee State of Hawai`i, on page 18 of the opinion.

IT IS FURTHER ORDERED that the clerk of the court is directed to incorporate the foregoing change in the original opinion and take all necessary steps to notify the publishing agencies of this change.
