APPEAL FROM THE FAMILY COURT OF THE FIRST CIRCUIT

ORDER(By: Duffy, J.)

Upon consideration of Appellee's motion to dismiss the appeal of Intervenors-Appellants for lack of jurisdiction, the papers in support and opposition, and the records and files herein, it appears that: (1) Appellee contends the appellate court lacks jurisdiction of the appeal because appellant have no standing to raise certain issues; (2) Appellee presents a similar argument in the answering brief. Therefore,

IT IS HEREBY ORDERED that the motion to dismiss for lack of jurisdiction is denied without prejudice to the court considering any arguments presented in the briefs.

DATED: Honolulu, Hawai‘i, January 11, 2006.
