IT IS HEREBY ORDERED that the motion for clarification is granted in part. The dismissal of this appeal for lack of jurisdiction means that the supreme court will not review the circuit court's October 11, 2005 order denying appellant's HRPP Rule 40 petition for post-conviction relief.
