IT IS HEREBY ORDERED that the opinion of this court, filed on November 27, 2006, is corrected as follows:

Pages 14 and 15: the references to HRCP and FRCP "Rule 27(c)" are corrected to read "Rule 26(c)"; and

Page 14: the parenthesis in "(see supra note 4" is deleted.

The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of these changes.
