PLEASE TAKE NOTICE that the July 29, 2005 Judgment on Appeal, entered in the above-captioned case by the Supreme Court of Hawai`i, was vacated by order of the Supreme Court of the United States on February 20, 2007. Therefore, Hawai`i Appeal No. 26657 is reopened for further consideration in light of the United States Supreme Court's mandate. Another disposition and Judgment on Appeal will be entered following this court's further consideration. IT IS FURTHER ORDERED that the Clerk of the Circuit Court of the First Circuit shall forthwith re-transmit the record
on appeal for CR. NOS. 03-1-1897, 03-1-2727, 03-1-2726, 03-1-2725, and 03-1-2724.
