DISSENTING OPINION BY ACOBA, J.

In line with my dissent in Freitas v. Admin. Dir. of Courts, 108 Hawai`i 31, 58, 116 P.3d 673, 700 (2005) (Acoba, J., dissenting as to Part III), I would hold that the "[Administrative Driver's License Revocation Office] hearings [should] be open to the public without the requirement of [identification] and sign-in restrictions and that recommendations of the [Department of Public Service] as are appropriate [with respect to security] be implemented."
