Petitioner/Petitioner-Appellant Michael Edward Coulter's application for a writ of certiorari, filed on April 23, 2007, is hereby accepted and will be scheduled for oral argument. The parties will be notified by the appellate clerk regarding scheduling.
IT IS FURTHER ORDERED that the parties shall, within 21 days from the date of this order, file a supplemental brief addressing the following issues:
Whether an individual has a right to due process in the procedures for determining their minimum term of imprisonment, under either the United States Constitution or the Hawai`i Constitution. If so, what constitutional due process guarantees must apply?
The supplemental briefs shall not exceed 15 pages.
