IT IS FURTHER ORDERED that the parties shall, within 21 days from the date of this order, file a supplemental brief addressing the following issues:

Whether an individual has a right to due process in the procedures for determining their minimum term of imprisonment, under either the United States Constitution or the Hawai`i Constitution. If so, what constitutional due process guarantees must apply?

The supplemental briefs shall not exceed 15 pages.
