Upon consideration of the "Complaint for Declaratory, Injunctive Relief and Damage Claims" submitted by Herman G. Lemusu, it appears that the supreme court does not have jurisdiction and power to award judgment on the complaint. See HRS § 602-5 (Supp. 2006). Therefore,

IT IS HEREBY ORDERED that the clerk of the appellate court shall file the complaint without payment of fees.

IT IS FURTHER ORDERED that the complaint is dismissed.
