ORDER OF CORRECTION

The memorandum opinion in the above-entitled appeal filed on May 30, 2008, is hereby corrected as follows, (deleted material in brackets, new material underlined):

1) on page 9 at the end of footnote 8, (Emphasis added.) shall be deleted.

2) on page 42, beginning on line 5, Plaintiff also notes that the jury found [Plaintiff] Defendant liable for $105,000 and that the final judgment against Defendant was for $119,923.24.

IT IS HEREBY ORDERED that the clerk of the court shall incorporate the foregoing changes in the original memorandum opinion.
