IT IS HEREBY ORDERED that Petitioner's motion is granted and the oral argument scheduled for August 7, 2008 is postponed.

IT IS FURTHER ORDERED that defense counsel shall file a statement by July 30, 2008, indicating a more definite conclusion date of his federal court trial.
