DISSENT BY NAKAYAMA, J., WITH WHOM HIRAI, J., JOINS

I dissent from the acceptance of the writ of certiorari. I cannot conclude that the Judges of the Intermediate Court of Appeals committed grave error by holding the Petitioner to the requirement that error be preserved in order to appeal. I would reject the writ of certiorari.
