Upon consideration of the motion for reconsideration of the September 29, 2009 order denying the September 18, 2009 motion for extension of time to file an application for writ of certiorari and for a copy of the record on appeal, it appears that, contrary to the suggestion of petitioner, the September 29, 2009 order did not deny the September 18, 2009 motion on the grounds the motion was not filed within the ninety-day period for filing an application for writ of certiorari. Therefore,

IT IS HEREBY ORDERED that the motion for reconsideration is denied.
