NO. 29577
IN THE
SUPREME COURT OF THE STATE OF HAWAI‘I
JOAQUIN AYRES COSTA RICA VI, Petitioner,
vs.
COUNTY OF
KAUAI, Respondent.
ORIGINAL PROCEEDING
ORDER
(By: Moon, C.J.,
Nakayama, Acoba, and Duffy, JJ.
and
Intermediate Court of Appeals Judge Foley,
assigned by
reason of vacancy)
Upon review of Joaquin Ayres Costa Rica's papers dated January 9, 2009,
which purport to be a petition for writ of
mandamus, it appears that the petition seeks supreme court review of
Civil No. 03-1-0084. We lack jurisdiction to review
Civil No. 03-1-0084. See
HRS § 602-5 (Supp. 2007). Therefore,
IT IS HEREBY
ORDERED that the clerk of the appellate court shall process the January
9, 2009 papers as a petition for
writ of mandamus without payment of the filing fee.
IT IS FURTHER
ORDERED that the petition for writ of mandamus is dismissed.
DATED: Honolulu,
Hawai‘i, January 23, 2009.
