Petitioner/defendant-appellant Victoria Lee Denis-Silva's application for a writ certiorari, filed on August 13, 2009, seeks review of a circuit court order filed on December 31, 2008 in Cr. No. 08-1-133K. The December 31, 2008 order of the circuit court is not reviewable by the supreme court by application for a writ of certiorari. See HRS § 602-59(a) (Supp. 2008). Therefore,

IT IS HEREBY ORDERED that the application for a writ of certiorari is dismissed.
