DISSENT BY ACOBA, J.

I respectfully dissent and would grant the petition for writ of mandamus. It is established that "[a] writ of mandamus and/or prohibition is an extraordinary remedy that will not issue unless the petitioner demonstrates [1] a clear and indisputable right to the relief requested and [2] a lack of other means to redress adequately the alleged wrong or to obtain the requested action." Kema v. Gaddis, 91 Hawai‘i 200, 204, 982 P.2d 334, 338 (1999) (emphasis added). Under the circumstances I believe both requirements are met in this case, and plainly there are no "other means" to "adequately" redress the wrongs. Id.
