ORDER GRANTING MOTION FOR RECONSIDERATION
(By: Moon, C.J., Nakayama, Acoba, Duffy, and Recktenwald, JJ.)

Upon consideration of Petitioner Jerome K. Muller's motion for reconsideration, and the record, it appears that the motion for reconsideration is supported by an exhibit showing service of his petition to resign and surrender license upon the Office of Disciplinary Counsel and the Hawai‘i State Bar Association, as required by this court's December 9, 2009 order. It further appears that Petitioner Muller's petition now complies with the requirements of Rule 1.10 of the Rules of the Supreme Court of the State of Hawai‘i (RSCH). Therefore,

IT IS HEREBY ORDERED that the motion for reconsideration is granted.

IT IS FURTHER ORDERED that Petitioner Muller's RSCH Rule 1.10 petition to resign and surrender his law license is granted. Petitioner Muller shall return his original license to practice law to the Clerk of this court forthwith. The Clerk shall retain the original license as part of this record. Petitioner Muller shall comply with the notice, affidavit, and record requirements of sections (a), (b), (d), and (g) of RSCH Rule 2.16.

IT IS FINALLY ORDERED that the Clerk shall remove the name of Jerome K. Muller, attorney number 3003, from the roll of attorneys of the State of Hawai‘i, effective with the filing of this order.
